These Terms of Use (“Terms”) govern your use of mobile applications developed and published by Julian Beck (“I”, “me”, “my”, “Apps”). By downloading, installing, or using any of my Apps, you agree to be bound by these Terms.

Use of Our Apps

My Apps are intended for personal, non-commercial use only. You agree not to:

  • Use the Apps for any illegal activities
  • Attempt to access or interfere with the Apps’ systems or networks
  • Reverse engineer, decompile, or disassemble any part of the Apps
  • Remove, alter, or obscure any proprietary notices in the Apps
  • Use the Apps in any way that violates applicable laws or regulations
  • Distribute, license, or sell the Apps or any content within them

Intellectual Property

All content, features, and functionality in my Apps (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are the property of Julian Beck or my licensors and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Apps without my express written consent.

User Content

Some Apps may allow you to create, upload, or process content (“User Content”). You retain ownership of your User Content. By using the Apps, you grant me a limited license to process your User Content solely for the purpose of providing the App’s functionality.

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to use and authorize the processing of your User Content
  • Your User Content does not infringe any third-party rights
  • Your User Content complies with all applicable laws

In-App Purchases

Some Apps offer in-app purchases. All purchases are processed through the Apple App Store and are subject to Apple’s terms and conditions. All sales are final, and refunds are handled according to Apple’s refund policy.

Disclaimer of Warranties

THE APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content

I do not warrant that:

  • The Apps will be available at all times or without interruption
  • The Apps will be error-free or that defects will be corrected
  • The Apps will meet your specific requirements
  • The results obtained from using the Apps will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JULIAN BECK SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of (or inability to access or use) the Apps
  • Any conduct or content of any third party on or related to the Apps
  • Any content obtained from the Apps
  • Unauthorized access, use, or alteration of your transmissions or content

Third-Party Services

My Apps may contain links to or integrate with third-party services, websites, or applications. I am not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

Indemnification

You agree to indemnify, defend, and hold harmless Julian Beck from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Apps
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

Termination

I reserve the right to terminate or suspend your access to the Apps at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Changes to Terms

I reserve the right to modify these Terms at any time. If I make material changes, I will provide reasonable notice through the Apps or other appropriate means. Your continued use of the Apps after such modifications constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Julian Beck regarding the use of the Apps and supersede any prior agreements.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
